If you like a service provider that we list, make sure you book them via THIS website... it helps them build their reputation. If you don't book via this service and you get a shonky job, you aren't able to leave feedback. This website is a service only and we can't be held responsible for the people you book. Whilst we encourage people to provide accurate information, it is your responsibility to do your own verification of the service provider listed on this site. Your use of the Greatjob website is governed by the following terms and conditions. By using the Greatjob website, you agree to also be bound by these terms and conditions.
If you are under the age of eighteen (18) years, you must obtain the consent of a parent or legal guardian prior to using the Greatjob website.
Greatjob may amend or update these terms and conditions from time to time without notice to you. You agree that you will comply with any additional terms and conditions that will be made available to you for the use of services provided through the website. Such additional terms and conditions are incorporated by reference into these terms and conditions.
Greatjob may suspend your use of the website if you breach these terms and conditions or if you misuse Greatjob in the subjective opinion of Greatjob.
Greatjob will not be liable to you, any service provider or any other party for any direct, indirect, consequential, incidental, special loss or other loss, damage, harm, expense, cost and/or liability arising out of or in connection with the website and these terms and conditions.
If a provision of this agreement is held to be illegal, invalid, void, voidable, avoided or unenforceable, that provision must be read down to the extent necessary to ensure that it is not illegal, invalid, void, voidable, avoided or unenforceable. If it is not possible to read down a provision as required in this clause, that provision is severable without affecting the legality, validity or enforceability of the remaining part of that provision or the other provisions in this agreement.
Definitions
Please note that some of the words used in the agreement have a special meaning. Those words are in bold and are defined as follows:
- Agreement
- This agreement between you and Greatjob which is binding on you upon acceptance by you of the terms and conditions.
- Content
- Any of the content displayed on the website.
- Greatjob
- The company known as Greatjob Pty Ltd (ABN 28 138 206 514) including its officers, agents, other partners, employees, executors, administrators, successors, employees, agents, contractors, substitutes and assigns.
- Service/s
- Any service/s provided by any service provider listed on the website.
- Service Provider
- Any person/s listed on the website providing services.
- Website
- The website having the domain names known as www.greatjob.com.au and/or www.greatjobkev.com.
- You
- The registered user of the website and any persons who may use the website through you.
Interpretation
In this agreement, unless the context expressly indicates a contrary intention:
- Headings are for convenience only and do not affect interpretation.
- A reference to any party includes that party’s executors, administrators, successors, employees, agents, contractors, substitutes and assigns, including any person taken by way of novation.
- Words importing the singular include the plural (and vice versa), words denoting a given gender include all other genders, and words denoting individuals include corporations (and vice versa).
- References to currency are references to Australian currency unless otherwise specifically provided.
- If a word or phrase is defined, then its other grammatical forms have a corresponding meaning.
- A reference to a person includes a body corporate, an unincorporated or other entity, and conversely, also includes a reference to that person's executors, administrators, successors, permitted assigns and substitutes, including but not limited to a person to whom this agreement is novated.
- A reference to a thing including but not limited to a right, includes a reference to a part of that thing.
- A reference to conduct includes, but is not limited to, an omission, statement or undertaking whether or not in writing.
- An agreement, representation or warranty in favour of two (2) or more persons is for the benefit of them jointly and severally.
- A release, discharge or from, indemnity for, Greatjob, includes Greatjob's officers, agents, other partners, employees, executors, administrators, successors, employees, agents, contractors, substitutes and assigns.
- A limitation of the liability of Greatjob extends to Greatjob's officers, agents, other partners, employees, executors, administrators, successors, employees, agents, contractors, substitutes and assigns.
- An agreement, representation or warranty on the part of two (2) or more persons binds them jointly and severally.
Content
You acknowledge and agree that Greatjob does not make any warranty or representation as to the accuracy, quality or completeness of the content.
As a user of the website, you should make and rely upon your own enquiries before entering into any transaction on the basis of, or in reliance upon, the content, whether directly or indirectly. Greatjob excludes all liability against it for any loss, damage, harm, expense, cost and/or liability arising from the use of the website or the content (whether the same has attributed, directly or indirectly, to any loss, damage, harm, expense, cost and/or liability), to the extent permitted by law.
You acknowledge and agree that you will forever release, discharge and hold harmless Greatjob from, and indemnify it against, any and all claims, demands, suits and/or actions (whether civil or criminal) relating to, directly or indirectly arising out of, or incidental to, all facts, matters or circumstances arising out of your use of the content or the website or any part of your use of the content or the website which has/have arisen or may arise in the future, either directly or indirectly attributable to anything from the content or the website.
You further acknowledge and agree that you will forever indemnify Greatjob against any and all loss, damage, harm, expense, cost and/or liability of Greatjob relating to, directly or indirectly arising out of, or incidental to your use of the content or the website, any breach by you of these terms, or any reliance by you on any information obtained through the content or the website.
Services
You acknowledge and agree that you will forever release, discharge and hold harmless Greatjob from, and indemnify it against, any and all claims, demands, suits and/or actions (whether civil or criminal) relating to, directly or indirectly arising out of, or incidental to, all facts, matters or circumstances arising out of the services or any part of the services which has/have arisen or may arise in the future, either directly or indirectly attributable to anything from the content or the website.
You further acknowledge and agree that you will forever indemnify Greatjob against any and all loss, damage, harm, expense, cost and/or liability of Greatjob relating to, directly or indirectly arising out of, or incidental to the services or any reliance by you on any information obtained through the content or the website.
Greatjob makes no warranty as to the quality, accuracy or completeness of any service requested by you from the website and/or provided to you. You are thereby responsible for any reliance on any information provided in the website which may (directly or indirectly) cause loss, damage, harm, expense, cost and/or liability.
Greatjob makes no warranty as to the quality, accuracy or completeness of any information provided by a service provider from the website. You are thereby responsible for any reliance on any information provided in the website which may (directly or indirectly) cause loss, damage, harm, expense, cost and/or liability.
Greatjob cannot and does not confirm that each service provider of the website has the qualifications, licenses or identity that the service provider may claim to have.
You agree that you will not use any service provided through the website in a manner that is illegal.
You acknowledge and agree that you may not contract with any service provider outside of the website for any service and agree to forever indemnify Greatjob against any and all loss, damage, harm, expense, cost and/or liability of Greatjob relating to, directly or indirectly arising out of, or incidental to the you contracting with any service provider outside of the website for any service expect where such initial introductions was outside the website and the website did not facilitate or lead to the contract being entered into between you and the service provider.
You agree that any contract entered into by you with any service provider (who was initially introduced to you via the website) not using this website shall be in breach of this agreement and you agree to forever indemnify Greatjob against all loss, damage, harm, expense, cost and/or liability of Greatjob relating to, directly or indirectly arising out of, or incidental to such breach.
Further Indemnity
You agree to indemnify and hold Greatjob harmless from any claim, demand, suit and/or action (whether civil or criminal) made by any third party due to or arising out of any services, your use of the website, your breach of these terms and conditions or your violation of any rights of another user of the website.
Confidentiality
Greatjob makes no guarantee that your use of the website will be confidential and is therefore not responsible for any loss, damage, harm, expense, cost and/or liability that you may suffer as a result of a breach of confidentiality in relation to your use of the website.
Third party websites
The website may contain links to third party websites. Greatjob is not responsible for the condition or the content of those websites. The link/s are provided for your convenience only and do not indicate, expressly or impliedly, any endorsement of the website/s or the products and/or services provided there (if any). You access those websites and use their products and services solely at your own risk.
Transactions
You may be able to make purchases of services through Greatjob. Where these services are provided by Greatjob's service providers, you acknowledge that you are purchasing those services under any further terms and conditions set by those service providers.
Although all reasonable care and diligence will be maintained at all times, Greatjob accepts no responsibility for the security or protection of any credit card details that you may provide to Greatjob's service providers when purchasing their services, and is not liable to you for any loss, damage, harm, expense, cost and/or liability that you may suffer due to unauthorised use of your credit card details.
Applicable Law
The website (excluding any linked third party websites) is owned and operated by Greatjob Pty Ltd. By accessing the website, you accept that any disputes about the content or the website are to be determined by the courts having jurisdiction in New South Wales and in accordance with the laws in force in New South Wales (subject to the application of any principle of conflict of laws inconsistent with this requirement).
Refunds and Returns
Greatjob does not offer refunds or returns on Services provided by Service Providers. Greatjob Clients should refer to the Terms and Conditions set by the Service Provider.
Greatjob does not offer refunds on SMS fees.
Greatjob does not offer refunds on Cancellation fees. The Cancellation fee is set by the Service Provider.
Greatjob will offer a credit to your Greatjob account on a Job Acceptance fee provided you have a nominated Workmate who has accepted the job that was originally given to you. No other refunds or credits are provided on Administration fees.
